Recent legislative developments have significantly impacted the hemp industry in our state, and we find ourselves at the forefront of a legal battle to protect our livelihood and your access to hemp-derived products.
In March 2024, Wyoming enacted Senate File 32 (SF 32), a law that redefines hemp and imposes stringent restrictions on hemp-derived products, particularly those containing psychoactive compounds like delta-8 THC. This legislation, which took effect on July 1, 2024, bans the production and sale of hemp products containing synthetic substances and certain psychoactive cannabinoids, effectively prohibiting products with delta-8 THC (WyoFile, 2023).
In response to SF 32, Platte Hemp Company, alongside several other hemp businesses across Wyoming, filed a lawsuit challenging the constitutionality of the new law. We argue that the ban is overly broad, infringes on our rights, and contradicts the federal definition of hemp established in the 2018 Farm Bill, which legalized hemp and its derivatives containing less than 0.3% delta-9 THC (Oil City News, 2024).Despite our efforts, a federal judge denied our request for a preliminary injunction to halt the enforcement of SF 32 while the case proceeds. The court ruled that the 2018 Farm Bill does not prevent states from enacting stricter regulations on hemp products and that Wyoming's law does not violate the Constitution (MJBizDaily, 2024).
While this ruling is a setback, it is not the end of our fight. We have filed an appeal with the Supreme Court and are currently awaiting our hearing. In the meantime, we are actively seeking support from our community to sustain our legal efforts.
